Agency Policies & Service Terms

These Agency Policies supplement and are incorporated into all signed service agreements. In the event of any conflict, the signed Service Agreement controls.

By booking services, submitting payment, or signing a contract with City Lights Beauty + Experiential Agency LLC (“CLBA,” “Agency,” “we,” or “us”), the Client (“you”) agrees to the following binding terms.

1. Booking Confirmation & Retainer

To reserve services, the Client must:

Sign the Service Agreement

Submit a non-refundable, non-transferable retainer equal to 50% of the total service fee, unless otherwise specified.

No services are confirmed without both signature and payment.

The retainer secures the event date and removes it from availability.

2. Payment Terms

Remaining balance is due no later than 30 days prior to the event date, unless otherwise stated in writing.

Payments are strictly non-refundable and non-transferable.

Late payments may incur a 10% late fee.

Balances unpaid more than 30 days after invoice due date may be referred to collections.

Client is responsible for any collection costs, legal fees, and administrative recovery expenses.

3. Cancellation Policy

Cancellation must be submitted in writing.

The retainer is non-refundable under all circumstances.

If cancellation occurs after the retainer is paid, all amounts paid remain non-refundable.

If cancellation occurs after final balance is due, full invoice amount remains payable.

Partial reductions in services (removing artists, reducing party size, shortening timeline) are treated as cancellations of contracted services and do not reduce the total contract amount.

Failure to provide written cancellation may result in the full balance remaining due.

4. Rescheduling

Rescheduling is subject to artist availability and current pricing.

Retainers remain non-refundable.

A new agreement and updated pricing may apply.

Rescheduled dates are not guaranteed until confirmed in writing.

If the Client voluntarily reschedules, the original retainer may be forfeited and a new retainer required.

5. Force Majeure

If services cannot be performed due to:

Government-mandated shutdown

Official evacuation order

Venue closure

Declared natural disaster

Public health emergency

The retainer may be applied one time to a new event date within twelve (12) months of the original date.

Rescheduled dates remain subject to artist availability and current pricing.

Payments remain non-refundable.

6. Professional Reputation & Non-Disparagement

Client agrees to:

Notify CLBA in writing within 48 hours of any service concerns.

Allow good-faith opportunity to resolve any issues.

Client agrees not to publish knowingly false, misleading, defamatory, or malicious statements about CLBA, its owner, employees, or contractors.

Confidential settlements or internal dispute discussions must remain private between the parties.

7. Creative Discretion

Each artist retains full professional discretion regarding:

Techniques

Tools

Products

Application methods

Specific product requests must be discussed in advance.

Airbrush services are not guaranteed; artists determine the most appropriate method based on skin type, environment, and desired outcome.

8. Photo & Video Release

Unless written notice is provided at least seven (7) days prior to the event, Client grants CLBA the right to:

Capture photographs and video

Use media for marketing, training, promotional, and portfolio purposes

Publish across digital and print platforms

9. Health & Liability

Client is responsible for disclosing:

Allergies

Skin sensitivities

Medical conditions

Transmittable conditions

CLBA is not liable for:

Allergic reactions

Skin irritations or infections

Damage to attire or personal property

Injuries not caused by gross negligence or willful misconduct

By proceeding with services, Client releases CLBA and its contractors from liability except in cases of gross negligence.

10. Travel & Accommodation

Client agrees to reimburse all travel-related expenses including but not limited to:

Mileage

Airfare

Ground transportation

Lodging

Parking, tolls, valet

Meals when overnight travel is required

Events beyond fifty (50) miles from artist base location may require overnight accommodations.

Travel fees are calculated based on event location and will be outlined in the invoice.

11. Conditional Fees

Early Morning Fee

$100 for services beginning before 8:00 AM.

On-Location Setup Fee

$100 venue-based setup fee where applicable.

Additional Artist Coordination Fee

$100 per additional artist when required due to service volume or timeline.

Hospitality

Client agrees to provide bottled water and allow sanitation/rest breaks as needed.

12. Service Fee

An 18% hospitality/service charge is applied to bookings and supports artists and administrative coordination.

Additional gratuity may be provided at Client’s discretion.

13. Scheduling Conflicts & Substitutions

In rare emergencies, illness, or scheduling conflicts, CLBA reserves the right to assign an alternate artist of equal or higher skill.

Substitution does not entitle Client to refund.

14. Entire Agreement

These policies supplement the signed Service Agreement.

No verbal modifications are valid.

Changes must be in writing and signed by both parties.

15. Governing Law & Dispute Resolution

These policies are governed by the laws of the State of Florida.

Any dispute shall be resolved through binding arbitration in the State of Florida.

Client agrees to reimburse reasonable attorneys’ fees and enforcement costs if CLBA prevails in any action to enforce this Agreement.

16. Binding Acknowledgment

By signing a Service Agreement or submitting payment, Client acknowledges that they:

Have read and understood these policies

Agree to be legally bound

Accept that all payments are non-refundable
